Every day in Ontario at least 2 people will be killed, and another 224 injured, as the result of motor vehicle collisions.
Very few people ever read their automobile insurance policies until they are involved in an accident. Even fewer people have read or understand the Insurance Act.
If you have been involved in an accident you need to know your rights.
Two Types of Auto Accident Claims: No- Fault and Tort
Following a car accident, there are two potential claims that you may advance.
The first is the so-called no-fault or Accident Benefits claim. As the name suggests, this claim can be advanced even if you were completely at fault for the accident.
The other potential claim is a tort claim or what is sometimes referred to as a "negligence" claim. This is a claim against the person you feel is responsible for the accident and your resulting injuries.
The two different types of claims are subject to various complicated regulations. Due to the complexity of the claims process, it is highly recommended that you seek professional legal council.
